
Important Update: Earned Sick Time Notice & Posting Requirements for Employers
As part of the latest amendments to the Earned Sick Time Act (ESTA), employers must comply with new written notice and posting requirements regarding earned sick time. Under Section 408.968 of the Act, all employers subject to this legislation are required to provide written notice to each employee either at the time of hiring or no later than 30 days after the effective date of the 2025 amendatory act—March 23, 2025—whichever is later. This written notice must include the following details:
- The amount of earned sick time an employee is entitled to under the Act.
- The employer's chosen method for defining a year, as specified under Section 3 of the Act.
- The terms and conditions under which earned sick time may be utilized.
- A prohibition on retaliatory personnel action, ensuring employees are protected when requesting or using earned sick time.
- The employee’s right to file a complaint with the department if there is a violation of this Act.
Additionally, employers are required to display the ESTA poster at their place of business in a conspicuous place that is accessible to employees.
By proactively informing employees and adhering to these requirements, employers can remain compliant while fostering a workplace that supports employees' rights and well-being.
